Terms of service

1. The service

Tovvana is online software for managing customer conversations, orders, bookings, leads and payments on chat channels such as WhatsApp, Instagram and web chat. Features may differ between Tovvana Shop and Tovvana Coach and may change as we improve the product.

2. Your account

• You must give accurate information and keep your login details safe.
• You are responsible for everything done through your account, including by team members you invite.
• You must be at least 18 years old and able to enter a contract on behalf of your business.

3. Plans, billing and cancellation

• Plans are billed per business, monthly or yearly, in advance. Prices are shown on our pricing page and exclude any taxes that apply.
• Add-ons (such as the AI assistant) and extra users are added to your bill.
• You can cancel at any time. Your access continues until the end of the period you paid for. Unless the law requires otherwise, payments are not refunded for partial periods.
• We may change prices with at least 30 days’ notice. New prices apply from your next billing period.
• Pilot or early access accounts may be free or discounted for a limited time, as agreed with you.

4. WhatsApp, Instagram and other third-party services

Tovvana connects to services run by others, such as Meta (WhatsApp, Instagram), Google (Calendar, Meet, Gemini) and payment methods. Your use of these services is also subject to their own terms. Meta may require business verification and charges some WhatsApp messages directly to you; these fees are not part of your Tovvana plan. We are not responsible for outages, policy changes or decisions made by these providers, including account restrictions.

5. Acceptable use

You agree not to use Tovvana to:

• send spam or marketing messages to people who have not agreed to receive them;
• sell illegal, counterfeit or prohibited goods or services, or break the WhatsApp Business and Meta commerce policies;
• harass, mislead or defraud anyone, or share content that is unlawful or harmful;
• try to access other businesses’ data, break our security, or overload the service;
• copy, resell or reverse engineer the software.

We may suspend an account that breaks these rules or puts other users or the service at risk.

6. Your data

You own the data you and your customers put into Tovvana. You give us permission to store and process it only to provide and support the service. You are responsible for having a lawful basis and any consent needed to message your customers and to share their data with us. Our privacy policy explains how we handle data.

You can export or ask us to delete your data. After an account is closed we delete its data as described in our privacy policy.

7. AI features

The AI assistant helps the bot understand typed messages. AI can make mistakes. You are responsible for checking important replies, prices and orders, and for the auto-replies and bot settings you choose. The AI assistant is offered on a fair-use basis.

8. Availability and support

We work to keep Tovvana available and secure, but we do not promise it will be uninterrupted or error-free. We may carry out maintenance and will try to give notice of planned downtime.

9. Professional services

Setup, data import, integrations, training and custom work are provided under a separate written proposal and contract that sets out the scope, timeline and price.

10. Our intellectual property

Tovvana, its software, design and brand belong to us. These terms give you a limited, non-exclusive right to use the service during your subscription. If you send us feedback, we may use it freely.

11. Limitation of liability

To the extent the law allows, Tovvana is provided "as is". We are not liable for indirect or consequential losses, such as lost profits, lost sales or lost data. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

12. Termination

You can stop using Tovvana at any time. We may end or suspend your account if you seriously break these terms or do not pay. Sections that by their nature should continue (such as liability and governing law) survive termination.

13. Governing law

These terms are governed by the laws of the Hashemite Kingdom of Jordan. The courts of Amman have jurisdiction over any dispute, unless the law requires otherwise.
